Welcome to Maqam ("App"), owned and operated by Maqam AI Inc. ("Company," "we," "us," "our"). These Terms and Conditions ("Terms") govern your access to and use of the App. By downloading, accessing, or using the App, you agree to be bound by these Terms. If you do not agree, do not use the App.
1. Eligibility
You must be at least 13 years old to create and hold your own account. If you are between 13 and the age of majority in your jurisdiction, you may use the App only under the supervision of a parent or legal guardian who agrees to these Terms on your behalf. If you are under 13, you may only use the App through an account created and controlled by a parent or legal guardian, consistent with applicable children's privacy laws. By using the App, you represent that you meet these requirements. We may refuse, suspend, or terminate access to anyone we reasonably believe does not meet these requirements or has provided false information.
The App is offered for iOS and Android. Availability on other platforms is not guaranteed.
2. Account Registration
2.1 You must create an account using one of our supported sign-in methods — Sign in with Apple, Google sign-in, or email registration — to access most features.
2.2 You agree to provide accurate, current, and complete information and to keep it updated.
2.3 You are solely responsible for maintaining the confidentiality of your credentials and for all activity under your account, and must notify us promptly of any unauthorized use.
2.4 We are not liable for any loss arising from your failure to safeguard your account.
2.5 When you register through a sign-in provider, you authorize us to receive certain profile information (such as name and email) from that provider, subject to that provider's own terms and privacy policy, which govern your relationship with them independently of these Terms.
3. The App; AI Features; Religious and Educational Disclaimers
3.1 Description. The App helps users practice Quran recitation style — including melody, pacing, pauses, ending shape, and stability — by comparing a user's recording to a selected Qari (or similar) reference. Certain features track practice progress (such as surahs, ayahs, sessions, and scores) and may provide visual guides, coaching suggestions, or scores. Certain features use artificial intelligence and machine learning technologies, including audio and speech-processing technologies, to analyze recitation and generate feedback, scoring, or suggestions ("AI-Generated Feedback"). By using these features, you acknowledge that you are interacting with an automated system, not a human reviewer or religious instructor.
The App is a style-comparison and practice tool. It is not a tajweed grader, certification program, or voice-identity matcher, and it does not claim that you "sound like" any particular Qari.
3.2 No Religious Authority. Maqam AI Inc. is not an Islamic scholarly institution, madrassa, or religious authority, and does not endorse any single school of jurisprudence (madhab) or mode of recitation (qira'ah) over another except as reflected in the specific content or method the App is built around. The App and any AI-Generated Feedback are supplementary educational tools only. They are not a substitute for instruction from a qualified Quran teacher, Qari, Imam, or Islamic scholar, and must not be treated as a religious ruling (fatwa) or an authoritative determination of correct tajweed or recitation. We make no representation that AI-Generated Feedback is religiously, phonetically, or technically accurate or complete. Please verify important matters of recitation and religious practice with a qualified human teacher.
3.3 AI Limitations. AI and machine-learning features are probabilistic and may produce results that are inaccurate, incomplete, or inconsistent between sessions. You accept these limitations when relying on AI-Generated Feedback.
4. User Content, Including Voice Recordings
4.1 "User Content" includes any audio recordings, recitations, or other material you submit through the App, including recitation recordings submitted for feedback ("Voice Data").
4.2 You retain ownership of your User Content. By submitting it, you grant Maqam AI Inc. a worldwide, non-exclusive, royalty-free, sublicensable license to host, store, process, transmit, and analyze it (including through our service providers) solely to operate, provide, maintain, and improve the App, and as described in our Privacy Policy. Unless you choose to save a recording on your device, Voice Data submitted for cloud analysis is processed temporarily and is not retained long-term by default.
4.3 You represent that you have the right to submit your User Content and that it does not infringe any third party's rights.
4.4 We may, but are not obligated to, monitor or remove User Content at our discretion.
5. Acceptable Use
You agree not to:
- use the App unlawfully or in violation of these Terms;
- reverse-engineer, decompile, or attempt to extract source code, models, or algorithms, except where prohibited by applicable law;
- use bots or scrapers against the App;
- upload content that is defamatory, obscene, infringing, or that you lack the right to share;
- interfere with the App's servers, networks, or security;
- impersonate any person or entity; or
- attempt unauthorized access to any part of the App or other accounts.
We may suspend or terminate access for violations at our discretion, with or without notice.
6. Intellectual Property
6.1 The Quran text and any established public-domain translations made available in the App remain in the public domain or belong to their respective rights holders; nothing here grants you rights beyond those you already hold to such texts. Reference audio and related timing data may be sourced from external providers and remain subject to their rights and terms.
6.2 All other App content, features, and functionality — software, design, interface, feedback algorithms, and compiled data formats — are owned by Maqam AI Inc. or its licensors and protected by applicable intellectual property laws.
6.3 We grant you a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. All rights not expressly granted are reserved.
7. Subscriptions and Purchases
7.1 Certain features may be offered on a paid or subscription basis through the applicable app store's in-app purchase system.
7.2 Billing, renewal, cancellation, and refunds are handled by that app store operator under its own terms; we do not process payment information directly and disclaim liability for its billing errors.
7.3 We may change pricing or subscription offerings at any time, subject to applicable law and app store requirements, and will provide advance notice of price changes to active subscribers where required by law.
8. Third-Party Services
The App relies on external services — including authentication providers, cloud hosting, analytics, and artificial intelligence and machine learning processing — to operate certain features. We do not control these providers and are not responsible for their acts, omissions, availability, or policies. Your use of any external service reached through the App is subject to that provider's own terms.
9. Disclaimer of Warranties
THE APP, ITS CONTENT, AND ANY AI-GENERATED FEEDBACK ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, OR ACCURACY. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR THAT ANY AI-GENERATED FEEDBACK WILL BE ACCURATE OR RELIABLE. YOU USE THE APP AT YOUR OWN RISK. SOME JURISDICTIONS DO NOT ALLOW THESE EXCLUSIONS, SO SOME MAY NOT APPLY TO YOU.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, MAQAM AI INC. AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE APP, REGARDLESS OF LEGAL THEORY AND EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE APP OR THESE TERMS WILL NOT EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE CLAIM AROSE, OR (B) CAD $100.
SOME JURISDICTIONS DO NOT ALLOW LIMITING LIABILITY FOR DEATH, PERSONAL INJURY CAUSED BY NEGLIGENCE, FRAUD, OR GROSS NEGLIGENCE, SO THOSE LIMITS MAY NOT APPLY TO YOU. NOTHING HERE EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW.
11. Indemnification
You agree to defend, indemnify, and hold harmless Maqam AI Inc. and its officers, employees, and agents from any claims, damages, losses, and expenses (including reasonable legal fees) arising from: (a) your use of the App; (b) your User Content; (c) your violation of these Terms; or (d) your violation of any third party's rights.
12. Dispute Resolution; Arbitration; Class Action Waiver
12.1 Agreement to Arbitrate. You and Maqam AI Inc. agree that any dispute arising from these Terms or your use of the App will be resolved through binding, individual arbitration rather than in court, except as set out below.
12.2 Exceptions. Either party may bring an individual claim in small claims court, or seek injunctive relief in court to protect intellectual property or prevent unauthorized access.
12.3 Class Action and Jury Waiver. YOU AND MAQAM AI INC. EACH WAIVE THE RIGHT TO A JURY TRIAL AND TO PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ACTION. DISPUTES WILL BE RESOLVED ONLY INDIVIDUALLY. IF THIS WAIVER IS FOUND UNENFORCEABLE AS TO A PARTICULAR DISPUTE, THE ARBITRATION AGREEMENT WILL NOT APPLY TO THAT DISPUTE, WHICH MUST INSTEAD BE BROUGHT IN COURT AS SET OUT BELOW.
12.4 Opt-Out. You may opt out of this arbitration agreement by emailing support@maqamapp.com within 30 days of first accepting these Terms, stating your name and that you wish to opt out. The class action waiver in 12.3 still applies to the extent enforceable under applicable law.
12.5 Governing Law. These Terms are governed by the laws of the Province of Ontario, Canada, without regard to conflict-of-laws principles, except where mandatory consumer protection laws of your place of residence apply and provide otherwise.
12.6 Where arbitration is unavailable or unenforceable, you and Maqam AI Inc. submit to the exclusive jurisdiction of the courts of the Province of Ontario, Canada, subject to any mandatory consumer-protection rules requiring otherwise.
13. Termination
We may suspend or terminate your access at any time, with or without cause or notice. You may stop using the App or delete your account at any time. Sections that by nature should survive termination (including 6, 9, 10, 11, 12, and 15) will survive.
14. Modifications to the App and These Terms
14.1 We may modify, suspend, or discontinue the App or any feature at any time without liability to you.
14.2 We may update these Terms at any time, in our sole discretion. When we do, we will update the "Last Updated" date and may, at our discretion, provide additional notice through the App, our website, email, or other means we consider appropriate. Notifying you of changes is a courtesy; except where applicable law requires a specific form or timing of notice, we are not obligated to notify you individually or in advance. Continued use of the App after a change takes effect constitutes acceptance of the revised Terms. If you disagree, your only remedy is to stop using the App.
15. General Provisions
15.1 Entire Agreement: These Terms, with our Privacy Policy, constitute the entire agreement between you and Maqam AI Inc. regarding the App.
15.2 Severability: If any provision is unenforceable, the rest remains in effect, and the unenforceable provision will be modified to the minimum extent necessary to be enforceable.
15.3 No Waiver: Our failure to enforce any right is not a waiver of it.
15.4 Assignment: We may assign these Terms without restriction; you may not, without our written consent.
15.5 Force Majeure: We are not liable for delays or failures caused by events beyond our reasonable control.
